SURF EQUIPMENT RENTAL TERMS & CONDITIONS

1. General Terms

By making a reservation and completing payment, the Customer confirms that they have read, understood, and accepted these Terms & Conditions in full.

Madeira Surfing Rentals provides surf equipment rental services, including but not limited to:

• Surfboards

• Wetsuits

• Surfboard Bags

• Leashes

• Fins

• Bodyboards

• Surf Skates

• Surf Boots

• Accessories

All renters are required to accept these Terms & Conditions before collecting any equipment.

The person responsible for the rental ("The Renter") must:

• Be at least 18 years old;

• Present a valid Passport or National ID;

• Accept full responsibility for all rented equipment throughout the rental period.

The Renter confirms that they are physically fit and capable of participating in surfing and related water sports.

Surfing is an activity that carries inherent risks, including serious injury or death. By renting equipment from Madeira Surfing Rentals, the Renter acknowledges these risks and voluntarily accepts full responsibility for participating in the activity.

Madeira Surfing Rentals takes every reasonable measure to ensure that all equipment is inspected and delivered in safe working condition.

The Renter agrees to inspect the equipment immediately upon collection and must report any existing damage before leaving the storage container.

Failure to report visible damage before using the equipment will be considered acceptance that the equipment was received in good condition.

Madeira Surfing Rentals cannot be held responsible for accidents, injuries, property damage, or losses occurring during the rental period, except where required by Portuguese law.

2. Payment & Security Deposit

Full payment is required before equipment is released.

A refundable security deposit is also required:

• €250 for Beginner and Intermediate Boards

• €350 for Performance Boards

The security deposit will be refunded after the equipment has been inspected and confirmed to have been returned in the same condition in which it was collected.

Security Deposit Authorisation

By providing a payment card for the security deposit, the Renter expressly authorises Madeira Surfing Rentals to charge any justified repair, replacement, cleaning, late return or missing equipment costs using the same payment method provided for the security deposit.

Photographic evidence will be retained whenever applicable.

Equipment inspections are normally completed within approximately 8 hours after return.

Depending on your bank, refunds may take 1–5 business days (or longer) to appear in your account.

Equipment Inspection Recommendation

To protect both the Renter and Madeira Surfing Rentals, we strongly recommend that you:

• Take clear photos or videos of every rented item before leaving the storage container.

• Send these photos immediately via WhatsApp to:

If the Renter leaves the container without documenting the equipment, they accept responsibility for any visible damage that was not reported before departure.

Failure to report any visible damage before leaving the collection point shall constitute acceptance that all equipment was received in perfect condition.

The Renter also confirms that they are able to swim and possess the physical ability required to safely participate in surfing and related water sports.

Equipment may only be rented to persons aged 18 years or older. Rentals involving minors require the written consent of a parent or legal guardian, who accepts full responsibility for both the minor and the rented equipment.

3. Equipment Use

The Renter agrees to:

• Use the equipment responsibly.

• Respect locals surfers

• Respect the Surf conditions.

• Choose beaches appropriate to their experience level.

• Keep all equipment secure at all times.

Equipment must:

• Be collected from the designated storage location.

• Be returned to the same location.

• Be returned on the agreed date and time.

Returning equipment early does not entitle the Renter to any refund.

The Renter is responsible for obtaining adequate personal insurance covering accidents, injuries, theft, and third-party liability.

Madeira Surfing Rentals accepts no responsibility for:

• Personal injury

• Death

• Theft

• Loss of personal belongings

• Damage caused during equipment use

Cancellation Policy

Reservations cancelled:

• More than 72 hours before the scheduled collection time are eligible for a full refund.

• Between 24 and 72 hours before collection are eligible for a 50% refund.

• Less than 24 hours before collection are non-refundable.

• Failure to collect the equipment ("No Show") is non-refundable.

Refunds are only considered in exceptional circumstances, including:

• Serious illness;

• Death;

• Medical incapacity.

Supporting documentation may be requested.

Leashes

Although Madeira Surfing Rentals supplies high-quality leashes, no leash is indestructible.

The Renter must inspect the leash before use.

If any defect is found, the equipment must not be used and Madeira Surfing Rentals must be informed immediately.

Damage caused by incorrect leash installation or misuse remains the responsibility of the Renter.

4. Additional Charges

The rental price does not include:

• Surf Wax (€5)

• Car Roof Rack (additional charge)

• Any optional accessories

Equipment may never be:

• Lent

• Sold

• Exchanged

• Sublet

Only the person responsible for the booking may use the rented equipment unless otherwise authorised.

Rental Extension

If the Renter wishes to extend the rental period, Madeira Surfing Rentals must be contacted before the original rental period expires.

Extensions are subject to equipment availability.

Equipment Return

All equipment must be returned:

• Clean

• Complete

• In the same condition in which it was supplied.

Any damage must be reported immediately upon return.

Failure to report damage may result in additional charges.

Weather Conditions

Weather conditions, wave size, wind, rain or other natural conditions do not automatically entitle the Renter to any refund.

Damage Charges

The following replacement or repair costs apply.

Replacement of surfboard locks, wetsuit locks, security cables, lock keys or any other locking devices:

€50 per item

Equipment Responsibility

The Renter accepts full responsibility for any damage resulting from:

• Contact with rocks or reefs;

• Collisions with other surfers or objects;

• Improper transportation;

• Incorrect storage;

• Negligence;

• Misuse of the equipment.

Equipment must never be left unattended on beaches, public places or attached to vehicles overnight.

Surfboards must always be transported using suitable roof racks or inside a vehicle.

Damage caused by incorrect transportation remains the sole responsibility of the Renter.

Repair charges apply depending on damage.

Hidden Damage Inspection

Some damage cannot be identified immediately when equipment is returned.

A complete inspection may be carried out after cleaning and drying the equipment.

If hidden damage is discovered during this inspection, Madeira Surfing Rentals will:

• Document the damage with photographs;

• Notify the Renter;

• Charge the repair cost using the same payment method used for the security deposit.

By accepting these Terms & Conditions, the Renter authorises Madeira Surfing Rentals to process these charges when justified.

Board Exchange

If a surfboard becomes damaged during the rental period but can still be exchanged, Madeira Surfing Rentals may provide another board but you have to pay 250/350€ deposit for the exchanged for a new board, subject to availability.

Before a replacement board is supplied:

• The first board will be inspected;

• Damage costs will be assessed;

• A new security deposit will be required.

If the new deposit is refused, no replacement board will be issued.

Rental Period

Rental prices are based on 24-hour periods, beginning at the agreed collection time.

Unused rental time is non-refundable.

Refunds are only considered in exceptional circumstances, including:

• Serious illness

• Death

• Medical incapacity

Supporting documentation may be requested.

VAT

All prices shown on the website include Portuguese VAT.

If you like to have the Invoice from damages we have to added 23% tax to de damage price in accordance with Portuguese tax legislation.

Jurisdiction

This Agreement shall be governed exclusively by Portuguese Law.

Any disputes arising from this Agreement shall fall under the jurisdiction of the Portuguese Courts.

Data Protection (GDPR)

Madeira Surfing Rentals processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Portuguese legislation.

Personal information is collected for the purpose of processing reservations, providing rental services, communicating with customers and complying with legal obligations.

Where the Customer has provided explicit consent during the booking process, Madeira Surfing Rentals may also use the Customer's contact details to send newsletters, promotional offers, discounts and marketing communications relating to its services.

The Customer may withdraw this consent at any time by contacting Madeira Surfing Rentals or by following the unsubscribe instructions included in marketing communications.

Required Before Equipment Collection

Before collecting your equipment, you must:

• Full Name

• Hotel or Accommodation Address in Madeira

• Mobile Phone Number

• A clear photo of a valid Passport or National ID

Failure to provide this information may delay or prevent equipment collection.

Declaration

By completing your booking and collecting the equipment, you confirm that:

• You have read these Terms & Conditions.

• You fully understand them.

• You agree to comply with all obligations described above.

• You accept responsibility for the rented equipment throughout the rental period.
